Licensing in brief

Status as of 23 October 2026

Fixed-odds betting is prohibited in Brazil. Provisional Measure (MP) 1,394, which entered into force on its publication on 25 September 2026, bans the operation, offer, intermediation and advertising of fixed-odds betting. The ban covers sports betting and online games, in physical and online channels, including operators based abroad that serve people in Brazil. Other lottery types authorised by law are not covered.

The MP has the force of law. The National Congress page for the measure lists a deliberation period running from 25 September to 23 November 2026. On 23 October 2026 the measure was awaiting the set-up of its joint committee.

Who regulates

The Secretaria de Prêmios e Apostas (SPA), part of the Ministry of Finance, oversees fixed-odds betting, lotteries and commercial promotions. Under the MP it keeps its supervisory and inspection powers over events that took place while authorisations were in force.

Licences and how to apply

No applications are possible. From 25 September 2026 no new federal authorisations may be granted, and applications not yet decided on that date lapse. Authorisations granted under Lei 14.790/2023 end 30 days after the MP's publication, with no refund of the authorisation fee. State and Federal District authorisations are covered as well.

From 1 January 2025 until the ban, only SPA-authorised companies could operate nationally, each authorisation covering up to three brands on .bet.br websites. The law capped the fixed authorisation fee at R$30m for three brands; that provision is now marked as repealed.

Taxes

Lei Complementar 224, dated 26 December 2025, set the rate on gross gaming revenue (GGR) at 13% for 2026, 14% for 2027 and 15% from 2028. The MP repealed Chapter V of Lei 13.756/2018, the chapter on fixed-odds betting whose Article 30 holds these revenue-share rules. The repealed rules still apply to activity carried out while authorisations were in force.

Advertising and safer-gambling rules

Payments

Financial and payment institutions may not process transactions for fixed-odds betting, except those needed to wind down operations and refund bettors. Since 25 September 2026 no new funds may be paid into betting platforms' transactional accounts.
