Licensing in brief

Status

Italy licenses online gambling through concessions. Remote betting, pools, horse-racing games, skill and card games, fixed-odds games of chance, peer-to-peer fixed-odds betting and bingo may be offered only under a concession awarded by public tender. The governing law is Legislative Decree No. 41 of 25 March 2024, which entered into force on 4 April 2024 and reorganised the sector starting with online play.

Who regulates

The Customs and Monopolies Agency (Agenzia delle dogane e dei monopoli, ADM) awards remote gaming concessions through public tenders. The Minister of Economy and Finance reports to Parliament on the public gaming sector by 31 December each year.

Licences and how to apply

Concessions are awarded only through a public tender, not on request. ADM launched the current tender on 17 December 2024 and accepted applications from 31 March 2025 until 17:00 on 30 May 2025. On 17 September 2025 it awarded concessions to all 46 operators that had applied, each receiving the number it requested. A participant and its corporate group could apply for at most five.

Each concession costs a one-off €7m, paid as €4m on award and €3m when the service starts. It runs for nine years from the concession agreement and cannot be renewed. Concessionaires also pay an annual concession fee of 3% of net margin in two equal instalments, due by 16 January and 16 July.

Taxes

Since 1 January 2025, remote skill and card games, fixed-odds games of chance and remote bingo pay the single tax (imposta unica) at 25.5% of gross gaming revenue (GGR); from 1 January 2019 remote skill games and bingo had paid 25%. Remote fixed-odds sports bets pay 24.5% of stakes minus winnings paid; remote fixed-odds bets had paid 24% from 2019.

Payments

Under an ADM determination of 22 October 2026, concessionaires may move money on gaming accounts only through payment instruments that keep financial flows traceable, and may not pay out withdrawals at top-up points of sale. Top-ups at those points in cash or with instruments other than the account holder's validated ones are capped at €100 a week in total. Since 13 November 2025, players opening an account can be identified through SPID or the electronic identity card (CIE).
